If a tree is growing within the boundary of your property, you have a responsibility to ensure it is maintained to a safe condition. You also have a duty of care under Common Law to ensure the tree does not cause damage or injury to others.
The law states that you are entitled to cut back branches from overhanging trees back to the boundary line, but it does not allow you to trespass. It is always best to discuss your concerns with the tree owner.
